Abstract

The purpose of this research paper is to account for the performance of the ALJ First of Armenia Quindio, from processes of understanding, interpretation and enforcement of judgments handed down in 2010 in the course of class actions, in order to recognize if these have been replaced or not the function of the executive planning and execution of public policies, for this the methodology used corresponded to a partner law firm of mixed cut, ie, qualitative - quantitative, with a hermeneutic historical approach, and scope exploratory - descriptive collection technique which corresponded to case study. According to the above it was possible to show that the executive of the departmental and municipal ignores the collective needs for building public policies to include in their development plans and public budgets resources for the satisfaction of collective needs, which requires the operator to partially replace legal executive in compliance with the constitutional mandate in a social state of law neoconstitucionalista conception.
