Abstract

The purpose of this study is to explain basic issues of the right to conscientious objection, by determining its foundation within the superior rule of the Spanish legal arrangement, as Constitutional right, based on a fundamental right. Once it is resolved, the reasons supporting its existence and application will be explained, in the case of the popular juries as an excuse by those selected to participate of the same.
